Article 1: General provisions
The e-commerce webshop Annabelle Vintage offers its customers the opportunity to purchase products from its online store online. These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this e-commerce webshop ("Customer"). Additional terms and conditions of the Customer are excluded, unless they have been expressly accepted in advance in writing.
Article 2: Price
All prices stated are expressed in euros and, unless otherwise stated, include VAT. If delivery, reservation or administrative costs are charged, this will be stated separately. The price statement applies exclusively to the items as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.
Article 3: Offer
Despite the fact that the online catalog and the e-commerce webshop have been compiled with the utmost care, it is still possible that the information provided is incomplete, contains material errors or is not up to date. Obvious mistakes or errors in the offer are not binding. The seller is under no circumstances liable in the event of manifest material errors, typesetting or printing errors. If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we request the Customer to contact the shop in advance.
The offer is valid while supplies last and can be adjusted or withdrawn at any time. The seller cannot be held liable for the unavailability of a product.
All items are without damage unless stated in the description.
Light signs of use may be present on vintage items.
Article 4: Online purchases
The Customer has the choice between bank card transfer or payment upon collection as payment methods.
The seller is entitled to refuse an order due to a serious shortcoming on the part of the Customer with regard to orders in which the Customer is involved.
Article 5: Delivery and execution of the agreement
Any visible damage and/or qualitative shortcomings of an item or other shortcomings in delivery must be reported by the Customer immediately.
The risk of loss or damage passes to the Customer once he (or a third party designated by him, who is not the carrier) has acquired physical possession of the goods.
Orders are always processed within 5 working days (working days are Monday - Friday) unless otherwise stated in the shipping method or due to closure due to public holidays or holiday periods. Closure for the holiday period is always clarified in the webshop. The standard delivery time is a maximum of 30 days, but in exceptional cases the delivery time may be longer. If the delivery period becomes longer than 30 days for this reason, the customer will be notified. If another reason should arise that affects the delivery period and makes it longer than 30 days, the customer will be informed directly.
Delivery to collection point
If a package is held at a customer collection point, it is the customer's responsibility to collect the package on time. If the package is returned to Annabelle Vintage, the customer will pay shipping costs again to receive the package. It can also be picked up at Annabelle Vintage. Orders that are returned due to late collection at a collection point cannot be canceled and cannot be refunded.
Article 6: Retention of title
The delivered items remain the exclusive property of the seller until full payment has been made by the Customer.
Article 7: Returns
Annabelle Vintage does not accept returns.
Article 8: Right of withdrawal
The provisions of this article only apply to Customers who purchase items online in their capacity as consumers.
The consumer has the right to withdraw from the agreement within a period of 14 calendar days, unless otherwise stated, without giving reasons, given that the right of withdrawal applies to the good or service ordered by the customer. To exercise the right of withdrawal, the Customer must inform the seller in a timely manner of his decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post or e-mail). The Customer must return or hand over the goods immediately after his decision to withdraw from the contract. The direct costs of returning the goods will be borne by the Customer unless otherwise agreed.
If the returned product has been reduced in value in any way, the right is retained to hold the Customer liable and claim compensation for any reduction in value. Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be returned.
In case the agreement includes the provision of services and if the Customer has requested that the provision of services begin during the withdrawal period, the Customer will pay an amount proportional to what has already been delivered at the time he informed us that he is withdrawing from the agreement, compared to the full performance of the agreement."
Article 9: Sanctions for non-payment
Without prejudice to the exercise of other rights, in the event of non-payment or late payment, the Customer is legally liable to pay interest on the unpaid amount from the date of the breach of contract and without notice. Without prejudice to the foregoing, the right is reserved to take back items that have not been (fully) paid for.
Article 10: Affect of validity - non-renunciation
If any provision of these Terms is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.
Failure at any time by the seller to enforce any of the rights listed in these Terms and Conditions, or to exercise any right thereof, will never be considered a waiver of such provision and will never affect the validity of these rights.
Article 11: Changes to conditions
These Terms and Conditions are supplemented by other terms and conditions that are explicitly referred to and the seller's general terms and conditions of sale. In the event of any contradiction, these Terms and Conditions shall prevail.
Article 12: Applicable law
Belgian law applies. The courts of the Seller's place of residence have jurisdiction in legal disputes. The Seller can also turn to the ODR platform.
